Below are the stipulations for exemption status found in the county rules as adopted 09/13/2007 §3.4 EXEMPTIONS FROM PERMITTING. (a) The following wells are not required to have a permit from the District: Page 11 (1) a well that is exempt from registration under Section 3.1(c): (a) Non-production monitoring wells; and (b) Temporary dewatering wells; and (c) Remediation wells; and (2) A NEW OR EXISTING WATER WELL ON PRIVATE PROPERTY THAT SERVES ONLY A SINGLE-FAMILY DWELLING USED ONLY FOR DOMESTIC PURPOSES; AND (3) A NEW OR EXISTING WATER WELL USED ONLY FOR AGRICULTURE; AND (4) a well used solely to supply water for a rig that is actively engaged in drilling or exploration operations for an oil or gas well permitted by the Railroad Commission of Texas provided that the person holding the Railroad Commission permit is responsible for drilling and operating the water well and the well is located on the same lease or field associated with the drilling rig; and (g) a water well authorized under a permit issued by the Railroad Commission of Texas under Natural Resources Code Chapter 134, provided the withdrawals are no greater than the amount necessary for mining activities specified in the Railroad Commission permit; and (b) A well exempt under Subsection (a) will lose its exempt status and must be permitted if the well is subsequently used for a purpose or in a manner that is not exempt under Subsection (a).
